Terms of Service

Please read these Terms of Service ("Terms") carefully before using the EventNote mobile application ("App") developed by Volodymyr Pysarenko ("Developer", "we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using EventNote, you confirm that you are at least 13 years of age, have read and understood these Terms, and agree to be legally bound by them. If you do not agree, do not use the App.
2. Description of the App
EventNote is a photography and event management application that allows you to:
- Create, manage, and organize photography and production events
- Track clients, contacts, deadlines, tasks, and pricing
- Collaborate with team members on shared events
- View sun position data for location planning
- Synchronize data across Apple devices via iCloud (Pro feature)
- Manage bookings and schedules
Some features require an optional account (Teams) or an active EventNote Pro subscription.
3. User Accounts
3.1 Teams Account
Certain collaboration features require you to register with an email address and password. You are responsible for:
- Providing accurate and complete registration information
- Maintaining the confidentiality of your password
- All activities that occur under your account
- Notifying us immediately of any unauthorized use of your account
We reserve the right to suspend or terminate accounts that violate these Terms.
3.2 No Account Required
Core event management and scheduling features are available without an account and work entirely offline on your device.
4. EventNote Pro Subscription
4.1 Pro Features
EventNote Pro unlocks premium features including iCloud sync across devices. Pro is offered as an auto-renewable subscription available through Apple's App Store.
4.2 Billing and Renewal
- Subscriptions are billed through your Apple ID account.
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
- You can manage and cancel your subscription in your Apple ID account settings at any time.
- No refunds are provided for partial subscription periods, except as required by applicable law or Apple's refund policies.
4.3 Price Changes
We may change subscription pricing with advance notice. Continued use after a price change constitutes acceptance of the new price.
4.4 Free Features
A significant portion of the App's features are available free of charge and will remain available without a Pro subscription.
5. Acceptable Use
You agree not to use the App to:
- Upload, store, or share content that is unlawful, harmful, abusive, defamatory, obscene, or otherwise objectionable
- Infringe on any intellectual property rights of others
- Impersonate any person or entity
- Transmit malware, viruses, or any harmful code
- Attempt to gain unauthorized access to the App, its servers, or any connected systems
- Use the App for any commercial purpose beyond managing your own professional events and bookings, without our prior written consent
- Reverse engineer, decompile, or disassemble any part of the App
- Circumvent, disable, or interfere with security-related features of the App
6. Your Content
6.1 Ownership
You retain ownership of all content you create within the App, including event data, client information, photos, and files ("Your Content").
6.2 License to Us
By uploading content to Supabase-backed features (Teams), you grant us a limited, non-exclusive, royalty-free license to store, display, and transmit Your Content solely as necessary to provide the Teams collaboration feature. We do not claim ownership of Your Content.
6.3 Responsibility for Content
You are solely responsible for Your Content and for ensuring you have the right to use, share, and store it. You must not upload content that violates any third-party rights or applicable law.
6.4 Content Removal
We reserve the right to remove content that violates these Terms or applicable law, without prior notice.
7. Team Collaboration
When you invite other users to team events or collaborate via the Teams feature:
- You are responsible for the accuracy of invitation details you provide.
- You must obtain any necessary consent from team members before sharing their information within the App.
- You are responsible for managing member access and permissions within your team.
8. Intellectual Property
The App, including its design, code, graphics, and content (excluding Your Content), is owned by the Developer and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-transferable, non-exclusive license to use the App on your Apple device(s) for personal or professional use in accordance with these Terms.
You may not reproduce, distribute, modify, or create derivative works from the App without our prior written permission.
9. Third-Party Services
The App integrates with third-party services (Supabase, RevenueCat, Apple iCloud, Google Places). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of any third-party services.
10. Privacy
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the data practices described in the Privacy Policy.
11. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT:
- The App will be uninterrupted, error-free, or secure
- Any defects will be corrected
- The App or the servers that make it available are free of viruses or harmful components
- Sun tracking data will be accurate or suitable for any specific professional purpose
Use of sun position data for professional photography planning is provided for informational purposes only. Always verify conditions on-site.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF REVENUE, OR LOSS OF BUSINESS, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR YOUR EVENTNTE PRO SUBSCRIPTION IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
13. Indemnification
You agree to indemnify, defend, and hold harmless the Developer from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:
- Your use of the App
- Your Content
- Your violation of these Terms
- Your violation of any rights of another person or entity
14. Data Loss
We strongly recommend enabling iCloud sync (Pro) and regularly creating local backups via the App's backup feature. The Developer is not responsible for loss of data stored locally on your device due to device failure, accidental deletion, or other causes.
15. Termination
15.1 By You
You may stop using the App at any time. To delete your Teams account and associated server-side data, use the account deletion option in Settings, or contact us.
15.2 By Us
We may suspend or terminate your access to the App or Teams account at any time, with or without notice, if we reasonably believe you have violated these Terms.
15.3 Effect of Termination
Upon termination, your right to use the App ceases. Provisions of these Terms that by their nature should survive termination (including Sections 6, 8, 11, 12, 13) shall survive.
16. Governing Law
These Terms are governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the App shall be resolved in accordance with the laws of the jurisdiction in which the Developer is located, without regard to conflict of law principles.
17. Changes to These Terms
We may modify these Terms at any time. We will notify you of material changes by updating the "Last Updated" date and, where appropriate, by posting a notice within the App. Your continued use of the App after the effective date of revised Terms constitutes your acceptance of the changes.
